You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately atsupport@apppecho-labs.comif you suspect any unauthorized access to or use of your account.
We may offer free and paid plans for access to the Service. If you subscribe to a paid plan, you authorize us and our third-party payment processor (for example, Stripe) to charge you the applicable subscription fees and any taxes, using the payment method you provide.
Unless otherwise stated at the time of purchase, subscriptions will automatically renew at the end of each billing period at the then-current price. You can cancel your subscription at any time through your account settings or by contacting us. Cancellations will take effect at the end of the current billing period.
Refunds, if any, are issued at our sole discretion and as required by applicable law.
You agree not to do any of the following while using the Service:
You retain ownership of the content you create, upload, or store in the Service ("User Content"). By using the Service, you grant AppEcho Labs a worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely as necessary to provide, maintain, and improve the Service.
You are responsible for ensuring that your User Content does not violate these Terms or applicable law and that you have all necessary rights and permissions to use and share your User Content through the Service.
The Service may provide AI-powered features to help you generate, summarize, or otherwise transform text. AI outputs are generated automatically and may be inaccurate, incomplete, or inappropriate for your context.
You are solely responsible for reviewing and verifying all AI-generated content before using it. AppEcho Labs does not guarantee the accuracy, completeness, or suitability of any AI-generated output and is not liable for any decisions or actions you take based on such output.
Except for your User Content, all rights, title, and interest in and to the Service, including the software, design, text, graphics, logos, trademarks, and all other materials, are owned by AppEcho Labs or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by us in writing.
The Service may integrate with or rely on third-party services, such as hosting providers, databases, analytics providers, payment processors, and AI model providers. Your use of any third-party services is subject to the terms and privacy policies of those third parties, and we are not responsible for their actions or practices.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We are not responsible for any loss of data, including loss of documents or content you create or store in the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPECHO LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.
TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless AppEcho Labs and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys fees, arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, or (c) your violation of these Terms or applicable law.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Virginia, and you and AppEcho Labs consent to the personal jurisdiction and venue of those courts.
We may modify or discontinue all or part of the Service at any time, with or without notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where required by law, provide additional notice.
By continuing to access or use the Service after any changes become effective, you agree to the revised Terms.
